In the event that a litigant desires to take an appeal from a Judgment or other final order of a Trial Court, the State of Florida maintains three separate Courts that have Appellate Jurisdiction. However, a litigant is only entitled to one appeal as a matter of right, and any addtional appeals are purely discretionary on the part of the Appeals Court.

    The Florida Supreme Court is the highest Court in the State of Florida and is the Court of last resort. Although appeals to the Supreme Court are primarily discretionary, the Supreme Court is required to hear appeals involving death sentences and decisions of the District Courts of Appeal declaring a provision of the Florida Constitution or a Florida State Law unconstitutional. The decisions of the Supreme Court are made by nine Justices.

    The District Courts of Appeal hear appeals as of right from the Judgments of the Circuit Courts. The Circuit Courts have Jurisdiction to hear and decide civil litigation involving $15,000.00 or more and criminal charges where the penalty exceeds incarceration for a period of more than one year. The decisions of the District Courts of Appeal are made by three Judge panels. The lower trial court, the County Courts involve civil cases for less than $15,000.00 and criminal charges involving less than a year in jail. Appeals from the County Court are heard by individual Circuit Court Judges.

    Mr. Perlman has written, argued and/or represented litigants in numerous appeals in the Circuit Courts, District Courts of Appeal of the State of Florida, the Florida Supreme Court, the United States Court of Appeals and the United States Supreme Court.
